Photo Contributions: Terms and Conditions
Aquarius Trail photo gallery contributors are individuals who submit content for the AquariusTrail.com photo gallery under either a casual or formalized arrangement.

As an Aquarius Trail contributor, you are solely responsible for ensuring that any content submitted to AquariusTrail.com photo gallery through the contributor process does not infringe any third party’s intellectual property rights or the rights of privacy or publicity of any third party. This includes text, photographs, or any other materials.

Pictures submitted to Escape Adventure must be original work. No images scanned from magazines, newspapers, etc. will be accepted. By submitting a picture, the submitter guarantees that the picture submitted is free of any copyright restrictions.

By submitting a photograph to our gallery, you hereby grant Escape Adventures an irrevocable, perpetual, royalty-free, worldwide non-exclusive license to use, reproduce, distribute and create derivative works from any such photograph. You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all User Submissions you transmit to Escape Adventures. You agree to indemnify and hold Escape Adventures, and its respective affiliates, directors, officers, agents, subcontractors, service providers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of (i) your User Submissions submitted or transmitted through the Website or other means, (ii) any violation of these Terms and Conditions of Use by you, or (v) any violation of any rights of a third party caused by you.

Right to refuse publication
Escape Adventures reserves the right to refuse publication of any contributed content that breaches EscapeAdventures.com’s terms of usage. Contributed content that would be refused includes:

• any material that breaches any laws or regulations, infringes upon a third party’s rights, or is contrary to any relevant standards or codes
• any material that interferes with other users or defames, harasses, threatens, menaces, offends or restricts any person, or inhibits any other user from using or enjoying AquariusTrail.com
• any obscene, indecent, inflammatory or pornographic material, or material that could give rise to civil or criminal proceedings
• any material that exceeds the maximum stated file size for submission
• any unreasonably or impractically large volume of material(s)

Right to edit or modify contributed content
Escape Adventure also reserves the right to modify or edit contributed content at our discretion in order to comply with our photo gallery standards.

LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL ESCAPE ADVENTURES BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE MATERIALS IN THIS SITE, EVEN IF ESCAPE ADVENTURES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
